“Simplaa UK” (A Global Transport Technology company registered in the United Kingdom, with company number 11063356) and, its London Partner entity Minicabline LTD (a limited company incorporated and registered in the United Kingdom, with company number 11063356, having its registered office at The Hub, 14 havelock Place Harrow together refers as “Simplaa” or “We”.

We hereby set out below how we use your personal data. Simplaa collects and processes personal data of (i) passengers in the course of installation and use of Simplaa app; and (ii) drivers in the course of installation and use of the Simplaa driver app, and during their registration and on-boarding and provision of services; under the relevant terms of use

 

TYPES OF PASSENGER PERSONAL DATA WE COLLECT AND PROCESS

Simplaa collects data about you because Personal data is processed to provide the service contracted with passengers. Data collected may include:

  • Name, telephone number, e-mail address probably during the installation of the app;

  • Where you register for an account, your user ID and password;

  • Where you choose to connect to the service from a third-party service, such as LinkedIn, Facebook, or Twitter, your information from that service;

  • Feedback ratings (including information provided to resolve disputes), payment information, and payment history;

  • Information relating to your booking requests, including geographical location of the user, the time of service, details of the route and destination; estimates of fares for your journey and price paid;

  • Text, images, and other user content you provide;

  • If Simplaa ban or suspend you from use of the service, the record of that ban or suspension;

  • Identification data of the device on which the relevant Simplaa app has been installed;

  • Details of app support queries you make.

  • Records containing details of any reported lost items.

  • Cookies of the https://simplaa.com website that save the website user’s telephone number and geographic location data.

 

REASONS FOR PASSENGER PERSONAL DATA RETENTION

Your personal data will be stored as long as you have an active passenger account. If your account is closed, personal data will be deleted (according to the policies set out in this section) from the databases, unless such data is required to be retained for accounting, dispute resolution, or fraud prevention purposes. This follows that:

  • Booking records will be retained for 12 months as per the PHV Operator license requirements.

  • Journey history data will be stored for 3 years, after which the data will become anonymous.

  • Any data required for accounting purposes will be stored for 7 years after the last journey.

  • Financial data regarding transportation services provided to passengers will be stored for 3 years after the last journey.

  • Simplaa will notify you after 2 years If your app is not in use. We would ask you to confirm whether you still wish to keep your account active. If no reply is received, the account will be closed and personal data will be deleted unless such data is required to be stored for accounting, dispute resolution, or fraud prevention purposes.

  • If there are suspicions of any criminal offense, fraud, or false information having been provided, the data will be stored for 10 years. In case of payment disputes, data will be retained until the claim is satisfied or the expiry date of such claims.

Please note that uninstallation of your Simplaa app on your device does not cause the deletion of your personal data.

TYPE OF PERSONAL DATA OF PHV DRIVERS WE COLLECT AND PROCESS

Personal data is processed for the actualization of the contract concluded with the driver at sign up.

We collect the following types of personal data from drivers:

  • Name, telephone number, email address, and banking or financial information;

  • Geographical locations when drivers are logged into the app;

  • Username and password for the app;

  • Information collected from third parties about you to verify any information you supplied to Simplaa during registration;

  • Details of journeys completed

  • Feedback ratings;

  • Fare estimates, actual fares and payments made to drivers;

  • Text, images, and other user content you provide;

  • If we withdraw your right to use the service, issue a warning a record of that withdrawal or warning;

  • Identification data of the device on which the relevant Simplaa app has been installed

  • Cookies of the Simplaa website save the website user’s telephone number and geographic location data;

  • Details of app support queries you make;

  • Passenger complaints including lost property;

  • Information about your driving license, your vehicle, and your insurance;

  • Background checks information under local licensing requirements, which may include medical certificates, topographical test certificates, and English language test certificates;

  • Data regarding criminal convictions and offenses is processed for compliance with a legal obligation;

  • Data may be processed on the ground of legitimate interest in an investigation and detecting fraudulent activities

  • Record of your information requested by law enforcement.

We collect and process the driver’s personal data to ensure that Simplaa regulatory compliance with drivers is met. We verifying the driver’s qualifications according to this professional activity, thereby safeguarding the contractual relations associated with the Simplaa app service. This includes resolving any driver service quality issues and monitoring your compliance on an ongoing basis.

Drivers' information on shift or at any time of using the Simplaa service can be viewed by an operational team. Any driver who would not like his or her geographic location to be visible to the dispatch operator can disable the app by tapping the “Terminate” button

REASONS FOR DRIVER PERSONAL DATA RETENTION

Drivers' personal data can be viewed and corrected in the Simplaa Driver module of the administrator system. Your personal data will be stored as long as you have an active driver's account: -

  • Booking records will be retained for 12 months as required by the PHV Operator license regulation.

  • If your account becomes closed, the personal data will be stored for an additional 2-year period.

  • All data necessary for accounting purposes shall be stored for up to 5 years.

  • In the event of suspicions of any criminal offense, administration, fraud, or false information, the data shall be stored for 10 years.

  • In the event of disputes, the data shall be retained until the claim is satisfactorily resolved or the expiry date of such claims.

We respond to any deleting and transferring personal data submitted by an email within 5 weeks. You will be notified of the period of data deletion and transfer.

WHY AND HOW WE USE THESE PERSONAL DATA

We collect and use these personal data for purposes of providing and for ensuring the safety of Simplaa passengers and drivers using Simplaa App. This includes the following:

  • We collect and process personal data to accept your journey request and connect the most suitable driver to fulfill your journey request;

  • We forward the passengers' geographical location data to drivers. Thereby, enabling them to decide on fulfilling the passenger’s requested journey. Once the journey is allocated, we also collect your telephone number to enable a driver to contact the passenger after the driver has accepted the journey;

  • We may use the personal data provided to resolve driver service quality issues or to improve our apps or for security and complying with law enforcement information requests when applicable.

  • We use contact details to notify you of updates to the Simplaa app;

  • If you have consented, we may contact you with promotional messages regarding the Simplaa app;

  • We collect data of the routes taken by the Simplaa app users which we use to analyze the geographic coverage to make recommendations to the drivers;

  • The personal data collected via the Simplaa app will be used for the identification of passengers and their location(s) to drivers;

  • We will hold and process your personal data during the periods your account is activated and then following our legal obligations;

  • Record of any requests for your information made by law enforcement.

  • Data may be processed on the ground of legitimate interest in an investigation and detecting fraudulent payments; and

Your personal data is processed to provide the service contracted with passengers. We collect and process the personal data submitted by the passengers in the course of Simplaa App installation and the use. The prerequisite for the use of Simplaa services is the passengers agreeing to the terms and conditions of use and processing of identification and geolocation data.

DIRECT MARKETING TO USERS

Your email address and phone number will only be used for sharing our product related marketing messages if you gave consent on the Simplaa.com website or in the Simplaa Riders or Drivers App. If you do no longer wish to receive direct marketing messages, please click the “Unsubscribe marketing messages” link in the header of our e-mail or Profile section of Simplaa Riders or Drivers App.

DISCLOSURE OF PERSONAL DATA TO LAW ENFORCEMENT

Simplaa is committed to ensuring the safety of all passengers and drivers using Simplaa service. We consider reports of misconduct seriously and we reserve the right, at our discretion, to release information to law enforcement whenever deemed necessary.

If it is brought to our attention that law enforcement requires information about your personal data for a criminal investigation, we will comply as long as their request is reasonable and such information is readily available within our reach.

Personal data that we may provide on request include:

  • Passenger’s and/or driver’s name(s)

  • Contact number

  • Date of birth (if available)

  • Home Address (if available)

  • Trip details including ie. start and finish time, pickup and drop off point

  • Details of the complaint made by the rider, driver, or applicable third party

Simplaa may, at our discretion, notify you that we have provided law enforcement with your personal data.

DISCLOSURE OF PERSONAL DATA TO THIRD PARTIES

The personal data of Simplaa App Riders is only disclosed to drivers who have active Simplaa App so that they will see the users' contact number, first name, and geographic location at the time of trip dispatch. The driver will be able to contact the user once they have accepted the journey for easier communication to meet successfully. 

Any feedback on the quality of the service is anonymous and drivers do not receive information on the names and telephone numbers of the users who provided feedback;

Simplaa discloses personal data to our third-party service providers, who may be located in countries outside of the EEA, subject to contracts with those third parties. These may include IT or payment services providers or driver verification check providers. Our payment provider Stripe is fully PCI compliant as one of the Level 1 Service Provider.

Your personal data may be shared with local licensing bodies, law enforcement, for legal reasons or in case of a change in our business ownership or assets.

YOUR RIGHTS AND DELETION OF DATA

Your personal data collected in the course of providing our services is transferred to and stored in the data centers of our Web Service provider -The Amazon Web Services Inc.. Only authorized Technical Team and employees of Simplaa Company and partners ​have access to the personal data and they may access the data only to resolve issues associated with the use of the services (including disputes regarding transportation services).

If you would like to delete your personal data collected by us, please email us with reasons for deletion at  support@simplaa.com

Once We receive the request, your account will be deleted. We will also contact you if there are any outstanding payments or as may be required for legal reasons. After an account deletion, the associated personal data becomes anonymized.

Please note that the uninstallation of your Simplaa App from your device does not apply to the deletion of your personal data. The deletion request of your personal data can be done only if we delete your account which is subject to our legal requirements to retain any personal data. As a result that you won’t be able to use Simplaa services under your existing account. 

Such a request for deletion takes within a month of receiving the email request.

CONCERNS AND UPDATES

Your Personal data can be viewed from the Simplaa Passengers or the Driver App Portal. Such information from Drivers App cannot be modified for security reasons. For any modification on the restricted parts will be required to send an email to support@simplaa.com with reasons for such modification. In some cases, proof may be required. Your right to make a complaint to the supervisory authority is not limited.
